Terms and Conditions of Use

I. GENERAL PROVISIONS

1. The online store available at polka-hebe.com (the “Store”) offers health and beauty products, cosmetics, personal care items, and related goods manufactured by reputable brands and suppliers. These Terms and Conditions apply to all purchases made through the Store.

3. These Terms and Conditions form part of the sales agreement concluded between the Store and the customer.

4. The Store’s services may be used by both individual consumers and business entities.

6. All prices displayed on the Store are listed in U.S. dollars (USD). Unless expressly stated otherwise, shipping charges, applicable sales tax, duties, and other charges are calculated separately at checkout or after the shipping destination is entered.

7. The price applicable to a product is the price displayed on the Store at the time the order is placed.

8. The Store reserves the right to modify prices, update the product assortment, introduce new products, discontinue products, and run, modify, or withdraw promotional campaigns at any time, provided that such changes do not affect orders already placed and accepted.

9. Product availability, pricing, and descriptions displayed on the Store at the time of order placement are binding with respect to that order, subject to correction of obvious clerical, technical, or pricing errors.

14. The Store may restrict access to its services or refuse service where reasonably necessary, including where:

a) a customer provides false, inaccurate, outdated, or misleading information;

b) a customer violates the rights, reputation, or safety of the Store, other customers, or third parties;

c) a customer engages in unlawful, abusive, fraudulent, or otherwise harmful conduct.

II. ORDERS

1. Orders may be placed through the Store’s website 24 hours a day, 7 days a week.

2. By placing an order, the customer confirms that all information provided, including billing, contact, and shipping information, is true, accurate, and complete.

3. Acceptance of these Terms and Conditions is required before submitting an order.

4. After an order is placed, the customer will receive an order confirmation email. Receipt of such email does not necessarily constitute final acceptance of the order.

5. The Store reserves the right to review, verify, and, if necessary, decline or cancel an order before shipment, including in cases involving payment issues, suspected fraud, product unavailability, or pricing or listing errors.

6. Orders are processed after successful authorization or receipt of payment, unless otherwise indicated at checkout.

7. Orders are fulfilled subject to product availability. If a product becomes unavailable after an order is placed, the Store may contact the customer to offer a substitute, partial fulfillment, delayed shipment, or cancellation with refund for the unavailable item.

8. The Store reserves the right to limit quantities purchased per customer, household, or order, particularly in cases of suspected resale, abuse, or fraudulent activity.

9. The Store may refuse or cancel an order if there are reasonable grounds to suspect unauthorized, deceptive, or unlawful activity.

III. PAYMENT

1. The Store accepts payment methods made available at checkout. Depending on the customer’s device, location, and the Store’s payment configuration, these may include major credit and debit cards, Shop Pay, Apple Pay, Google Pay, PayPal, and other payment methods displayed at checkout.

2. Payment must be successfully authorized before an order is processed and shipped, unless the selected payment method expressly provides otherwise.

3. The customer represents and warrants that they are authorized to use the selected payment method.

4. If payment authorization fails, is reversed, or is reasonably suspected to be unauthorized or fraudulent, the Store may suspend, refuse, or cancel the order.

5. The Store reserves the right to correct obvious pricing or payment processing errors and to cancel orders affected by such errors, with notice to the customer and refund where applicable.

IV. SHIPPING AND DELIVERY

1. The Store currently accepts and ships orders within the United States and, if offered at checkout, to selected international destinations including Canada. Availability of shipping destinations may change at any time.

2. Shipping charges are shown at checkout before the order is submitted.

3. Orders are shipped using third-party carriers selected by the Store or made available at checkout.

4. The Store may ship to both residential and P.O. Box addresses where supported by the selected carrier and shipping method.

5. Customers are solely responsible for ensuring that the shipping address and delivery information provided are accurate, complete, and deliverable. The Store is not responsible for delays, failed delivery, loss, or additional costs resulting from incorrect, incomplete, or undeliverable addresses provided by the customer.

6. Orders are typically processed and shipped on business days only, excluding weekends and holidays, unless otherwise stated on the website.

7. Any delivery dates or transit times displayed on the website, at checkout, or in shipping notices are estimates only and are not guaranteed.

8. Once an order has been transferred to the shipping carrier, the risk of shipping delays caused by the carrier, weather, customs, or other events outside the Store’s reasonable control passes to the extent permitted by applicable law.

9. The Store is not liable for delivery delays occurring after the order has been handed to the carrier, except where otherwise required by law.

10. If a package is returned to the Store due to an incorrect address, failed delivery attempts, or refusal by the recipient, the Store may require the customer to pay additional shipping charges before reshipment.

VII. CANCELLATIONS

2. Once an order has been processed or shipped, it may no longer be canceled and will instead be subject to the Store’s return policy, if eligible.

XII. FINAL PROVISIONS

1. If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

2. The Store’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

3. These Terms, together with the Privacy Policy, Return Policy, Shipping Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between the customer and the Store regarding use of the website and purchases made through it.
